Foreign Insurers
Nebraska utilizes the NAIC Uniform Certificate of Authority Application ("UCAA") for expansion applications of foreign insurers. Nebraska prefers all information, including biographical affidavits, be electronically uploaded to the UCAA. There are no state specific requirements.

- Fees - The Department has a $1,000 non-refundable pre-admission review fee that is retaliatory. This fee can be paid through our online payment portal. Select UCAA fees, Expansion application, and then upload a copy of the 2E.

- Once the application is approved, there is a $300 Certificate of Authority issuance fee of $300 that can be paid through the online portal. Select Certificate of Authority issuance.

Nebraska utilizes the NAIC Certificate of Authority Application ("UCAA") Corporate Amendment for the filing of company changes for foreign insurers authorized to do business in the state. Nebraska prefers all information related to the corporate amendment be uploaded electronically to the UCAA, including biographical affidavits if applicable.

Other Entities
Companies wishing to operate as an Advisory Organization in Nebraska are required to have a Certificate of Authority ("CoA") to do so.
- Application - The application requirements are listed in Neb. Rev. Stat. § 44-7523. Complete the application and submit it and the information requested electronically to doi.companylicensing@nebraska.gov. There is a $300 application fee which can be paid through the online portal, https://ne.accessgov.com/doi/Forms/Page/doi/misc-payments/. Select Other and indicate it is payment for an Advisory Organization application.
- Annual Requirements - Advisory Organization CoA's expire annually on April 30. The renewal fee is $100 and should be submitted through the Department's online portal. The renewal and payment should be received by the Department on or before April 1 of each year.

Motor Club Service organizations (Motor Club) in Nebraska are required to have a certificate of authority ("CoA") to do so. A Motor Club is defined in Neb. Rev. Stat. § 44-3703 and 44-3707 and can be accessed via the statutory reference.
- Application - There is a $100 application fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. Application requirements are listed here and Neb. Rev. Stat. § 44-3712.
- Before a Motor Club can be authorized they must also have a deposit of $50,000 in cash or securities with the Department or a surety bond of $50,000. Additional information regarding this can be found in Neb. Rev. Stat. § 44-3709.
- Annual Requirements - Motor Club CoA's expire annually on April 30. The renewal fee is $100 and should be submitted through the Department online portal. Multiple Employer Welfare Arrangements ("MEWA") if they meet the definition under 29 U.S.C. 1002 and are sponsored by an association of employers that offer a health benefit plan that is not fully insured.
- Application - There is a $1,000 application fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. Application requirements are listed here and Neb. Rev. Stat. § 44-7605.
- Annual Requirements - The renewal fee is $200 and should be submitted through the Department's online portal. The renewal and payment should be submitted to the Department within 90 days of the end of the fiscal year or no later than March 31. Additional information regarding the renewal can be found in Neb. Rev. Stat. § 44-7613. You will need to complete the renewal form and attach financial statements (balance sheet and income statement), actuary reports, and compliance reports.

Pharmacy Benefit Managers ("PBM") in Nebraska are required to have a certificate of authority ("CoA") to do so. A PBM is defined in Neb. Rev. Stat. § 44-4603.
- Application - There is a $500 application fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. Application requirements are listed in Neb. Rev. Stat. § 44-4605.
- Annual Requirements - PBM's CoA's expire one year from date of issuance. The renewal fee is $250 and should be submitted through the Department's online portal. The renewal and payment must be received on or before 30 calender days prior to expiration. Additional information regarding the renewal can be found here and Neb. Rev. Stat. § 44-4605.

Purchasing Groups ("PG") in Nebraska are required to be registered with the Department of Insurance. A PG is defined in Neb. Rev. Stat. § 44-4403.
- Application - There is a $100 registration fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. Application requirements are listed here; additionally, you will need to complete and upload the Purchase Group Part B form with the application. Further information found in Neb. Rev. - Annual Requirements - The renewal fee is $100 and should be submitted through the Department's online portal. The renewal and payment should be submitted to the Department on or before October 1. - NAIC Model Risk Retention Act

Risk Retention Groups ("RRG") in Nebraska are required to be registered with the Department of Insurance. A RRG is defined in Neb. Rev. Stat. § 44-4403.
- Application - There is no fee for the registration application and it should be completed through the Department's online portal. A sample application can be found here; additionally, you will need to complete and upload the Purchase Group Part B form with the application. The requirements are found in Neb. Rev. Stat. § 44-4405.
- Annual Requirements - There is no renewal fee; however, there is a $200 Annual Statement fee that is collected as part of the annual premium tax return. Annual premium tax returns are required to be filed with the Department on or before March 1. Additional information regarding the premium tax filing can be found here.

Third Party Administrators ("TPA") in Nebraska are required to have a certificate of authority ("CoA") to do so. A TPA is defined in Neb. Rev. Stat. § 44-5802.
- Application - There is a $200 application fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. Additional information regarding completing the application can be found here and Neb. Rev. Stat. § 44-5812.
- Annual Requirements - An annual statement and $200 filing fee is required to be submitted to the Department no late than March 1. The fee can be paid when submitting the Annual Statement. Viatical Settlement Providers ("VSP") in Nebraska are required to have a certificate of authority ("CoA") to do so. A VSP is defined in Neb. Rev. Stat. § 44-1102.
- Application - There is a $1,000 registration fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. Application requirements can be found here and Neb. Rev. Stat. § 44-1103.
- Before a VSP can be authorized they must also have a deposit of $250,000 in cash or securities with the Department of a surety bond of $25,000. Additional information regarding this can be found in Neb. Rev. Stat. § 44-1103 and accessed via the statutory reference link below.
- Annual Requirements - VSP CoA's expire annually on April 30. There is a renewal fee of $100 which should be submitted through the Department's online portal with the Viatical Provider Annual Report. There is also a $200 filing fee that should be submitted through the Department's online portal with the Viatical Provider Mortality Report. Discount Medical Plan Organizations ("DMPO") in Nebraska are required to have a certificate of authority ("CoA") to do so. A DMPO is defined in Neb. Rev. Stat. § 44-8303.
- Application - There is a $500 registration fee that can be paid when submitting the application. The application should be submitted through the Department's online portal. - Annual Requirement - The renewal fee is $300 and should be submitted through the Department's online portal. The renewal and payment should be submitted to the Department on or before April 1. Pre-Paid Dental Service Plans ("PDSP") in Nebraska are required to have a certificate of authority ("CoA") to do so. A PDSP is defined in Neb. Rev. Stat. § 44-3802.

- Annual Requirement - The CoA renewal fee is $100 and there is also a $200 annual statement filing fee, both of these fees are collected with the annual premium tax filing. Pre-Paid Limited Health Service Organization ("PLHSO") in Nebraska are required to have a certificate of authority ("CoA") to do so. A PLHSO is defined in Neb. Rev. Stat. § 44-4702.

- Annual Requirement - There is no CoA renewal fee; however, there is a $50 annual statement filing fee which is collected with the annual premium tax filing. Pre-Paid Legal Service Insurers ("PPLSI") in Nebraska are required to have a certificate of authority ("CoA") to do so. A PPLSI is defined in Neb. Rev. Stat. § 44-3302.

No individual or company shall make or offer to make any pre-need burial trusts sales without first obtaining a pre-need agent or seller license from the Nebraska Department of Insurance ("Department").
- Application - An annual report is required to be submitted to the Department along with a $50 fee no later than June 1 of each year. The annual statement and fee can be submitted via the online portal, Individual Trust and Master Trust. The Department will also accept hard copy statement, Individual Trust and Master Trust, with a check made payable to the Nebraska Department of Insurance.

Other Information
All foreign and domestic insurers are required to hold on deposit at least $100,000. HMO's are required to hold $300,000 according to Neb. Rev. Stat. § 44-319.02 and Neb. Rev. Stat. § 44-319.06.

- Steps for Obtaining a deposit:
- 1. Contact one of the depository banks on the list below and arrange to purchase securities for depository purposes. Be sure to advise the bank that this is to be pledged to the Nebraska Department of Insurance ("Department")
- 2. The Securities Control Agreement must also be completed and signed by company, bank, and the Department
- 3. The securities pledged must be in the name of the company and the Department
- 4. The securities that are most often pledged are U.S. Treasury Notes, however, any security which is registered in the NAIC Valuations of Securities Database will be acceptable. Pursuant to Neb. Rev. Stat. § 44-150 the required amount for security deposits is subject to retaliation. The security being used to fund the deposit must be approved by the Department prior to being purchased.
- 5. Upon completion of the purchase, the bank is required to send to the Department the pledge receipt which gives a description of the security including the maturity date, rate and amount and indicating the security is pledged to the Department.
- 6. The Department will send to the company a Nebraska Departmental receipt, which the company will maintain until the securities are to be released. The Department will also send the company a Certificate of Deposit.
- 7. When the company wishes to release the securities, they must return the Departmental receipt to our office for authorization of release to the bank. This can be sent electronically to doi.statutorydeposits@nebraska.gov. The Department will then forward to the bank the safekeeping receipt or joint custody trust receipt authorizing the release of the securities.
