On May 3, 2010, the Nebraska Department of Insurance filed a Summary Order to Cease and Desist against American Trade Association, Smart Data Solutions LLC, Serve America Assurance, and numerous other entities and individuals requiring them to immediately CEASE AND DESIST from issuing, making, providing, selling or offering, either directly or indirectly, insurance benefits in the State of Nebraska which are not insured by an insurer licensed to transact insurance in the state. On May 20, 2010, the Chancery Court of Davidson County, Tennessee, entered a Final Order of Liquidation and Permanent Injunctive Relief against the abovenamed entities wherein Leslie A. Newman, Commissioner of the Tennessee Department of Commerce and Insurance, is appointed as Liquidator of Smart Data Solutions, American Trade Association and Serve America Assurance. The Liquidator will cause a website at www.americantradeliquidation.com to be maintained so as to provide up-to-date information about the liquidation and answers to frequently asked questions.
Please note it has been brought to the attention of the Department and courtappointed Liquidator that letters are being sent to American Trade Association members regarding moving health insurance plans. At this time, there has been no authorized rollover of American Trade Association members by the Liquidator and/or Smart Data Solutions to put or place members in any other membership association for health insurance. Furthermore, the Liquidator has not authorized any other entity to debit any bank or credit cards of American Trade Association members. If you have had your membership in American Trade Association rolled over into another association or entity, please contact the Department’s toll free consumer hotline at 1-877-564-7323.
Whenever purchasing health insurance over the telephone, Internet, or from an unsolicited letter of fax, please use caution and check with the Nebraska Department of Insurance to determine if an entity that you are dealing with is properly licensed and assure yourself that the individual you are dealing with is a licensed insurance producer of that entity.
