NOTICE OF ADOPTION- Chapter 36, Regulation to Implement the Medicare Supplement Insurance Minimum Standards

Chapter 36 of the Insurance Department Rules was filed with the Secretary of State for adoption on June 18, 2009, with an implementation date of June 23, 2009.

Chapter 36 entitled, “REGULATION TO IMPLEMENT THE MEDICARE SUPPLEMENT INSURANCE MINIMUM STANDARDS” was amended to comply with the Medicare Modernization Act of 2003 (MMA), the Medicare Improvements for Patients and Providers Act of 2008 (MIPPA), and the Genetic Information Nondiscrimination Act of 2008 (GINA); along with changes to the National Association of Insurance Commissioners Medigap model. The amendments will create two new Medicare Supplement plans, and eventually eliminate the prescription drug benefit for the Medicare Supplement plans.
