To: All Pre-Need Sellers in Nebraska
The Department of Insurance is working to achieve a higher quality of oversight to benefit the citizens of Nebraska. In order to achieve this goal, the Department must obtain more transparent information from Nebraska’s pre-need sellers.
Please submit the information requested below which will serve as an addendum to your 2010 Annual Report. This information is requested separately from your Annual Report for confidentiality purposes. The Annual Report is accessible to the public; the information being requested herein will be kept confidential pursuant to UNeb.Rev.Stat.U §44-5906(8)(a).
Individual Trust Accounts
If you utilize individual trust accounts, please provide:
- A complete listing of all pre-need sales contracts, preferably in an electronic format such as Microsoft Excel. The listing should be sorted by date of contract and contain the following information for each contract:
- Trust account number
- Name of the pre-need contract purchaser
- Date of the contract
- Total contract cost
- CPI retained during 2010
- Identify all contracts being funded by installment payments
- Identify the contracts by New, Performed and Cancelled during 2010
- Include final balances for contracts performed and cancelled during 2010
- Trust account balance(s) as of December 31, 2010
- Documentation from each trustee confirming the December 31, 2010, balances reported on Schedule(s) IA. The documentation may be in the form of a copy but it must be clearly sourced from the trustee.
Master Trust Accounts
If you utilize a master trust account(s), please provide:
- A complete listing of all pre-need sales contracts in an electronic format such as Microsoft Excel. The listing should contain the following information for each contract:
- Contract ID number
- Name of the pre-need contract purchaser
- Date of the contract
- Total contract cost
- Trust account balance(s) as of December 31, 2010, at market value
- 2009 income distributed during 2010
- Net principal added to trust during 2010
- Identify contracts being funded by installment payments
- Agreements performed during 2010
- Cancellations during 2010
- Construction distributions during 2010
- Net trust income / (losses), realized and unrealized, during 2010
- Trustee fees / expenses, including taxes, during 2010
- Trust account balance(s) as of December 31, 2010, at market value
- Documentation from each trustee confirming the December 31, 2010, balances reported on Schedule(s) IB. The documentation may be in the form of a copy but it must be clearly sourced from the trustee.
If you utilize both trusting methods, please provide the information as requested above for each type of trusting method.
