All active producers’ appointments will be automatically renewed May 1, 2009, unless canceled by the insurance company prior to April 15, 2009. Therefore, if you plan to terminate a producer’s appointment, be sure to mail the cancellation form or terminate the appointment through the Producer Database in time to reach the Department before the deadline date.
Request for Cancellation Forms Received after April 15, 2009
In the event the cancellation form is received in the Department after April 15, 2009, the appointment will renew on May 1, 2009 and the renewal fee must be paid. Cancellation forms received after April 15, 2009, will be processed in May or June 2009 and the cancellation of appointment will appear on your May or June 2009 monthly billing statement.
Neb.Rev.Stat. §44-4062(1) provides that if the appointment of a licensed producer by an insurance company is terminated, the insurer shall notify the director within thirty days of the termination. The insurance company is required to notify the insurance producer of termination pursuant to Neb.Rev.Stat. §44- 4062(6)(a).
Producers’ appointments are automatically non-renewed if the producer has failed to renew his or her license, or if a license is non-renewed for noncompliance of the two-year continuing education requirement.
Important
Monthly, we forward a list reflecting the names of producers appointed on behalf of your company who have failed to renew his or her license and the names of licensees who have moved from this state.
The reason for non-renewal of a producer’s license will be indicated under the “non-billable cancellations” as follows:
- Person’s License Expired - This means that the producer did not renew his or her license.
- Moved From State - This means that the producer has moved to another state and has requested a Letter of Clearance from Nebraska.
- If a producer’s license is revoked or suspended or if a licensed producer is placed on probation or fined, a copy of the final order will be sent to every insurance company for which the producer held an “active producer’s appointment” on the date the action was taken. If an appointment is canceled for any other reason, the insurance company will be notified, in writing, as to the reason for cancellation.
- If a producer’s license expires and the person reapplies and is issued a license, a Midwest Zone Appointment/Termination or PIN submission is required to reappoint the producer.
New Appointments
An insurance producer shall not act as an agent of an insurer unless the insurance producer becomes an appointed producer of that insurer pursuant to Neb.Rev.Stat. §44-4061.
New appointments received on or before April 15, 2009, will be processed and issued for the year ending April 30, 2009 and renewed for the May 1, 2009 - April 30, 2010 appointment year, unless it is indicated on the appointment form that the appointment is to be effective May 1, 2009. Appointments received after April 15, 2009, will be issued effective May 1, 2009.
