NOTICE OF HEARING - Chapter 36 -- Regulation to Implement the Medicare Supplement Insurance Minimum Standards

The Director of the Department of Insurance has scheduled a public hearing as required by Neb. Rev. Stat. §84-901 to §84-909 for the proposed amendment of Title 210, Nebraska Administrative Code, Chapter 36, Regulation to Implement the Medicare Supplement Insurance Minimum Standards. The proposed amendments to the current regulation are being done to comply with the Medicare Modernization Act of 2003 (MMA), the Medicare Improvements for Patients and Providers Act of 2008 (MIPPA), and the Genetic Information Nondiscrimination Act of 2008 (GINA); along with changes to the National Association of Insurance Commissioners Medigap model. The amendments will create two new Medicare Supplement plans, and eventually eliminate the prescription drug benefit for the Medicare Supplement plans. There may be a fiscal impact due to potential actuarial adjustments. A copy of the Fiscal Impact Statement is available at the Department of Insurance or on the Department’s website at www.doi.ne.gov.

Requested copies of amended Chapter 36 are available at a cost of $70.50 each. Copies of Chapter 36 are available for inspection at the aforementioned address, as well as the Office of the Secretary of State, State Capitol Building, Room 2300, Lincoln, NE 68509, and through the Department’s website at www.doi.ne.gov. All persons interested in presenting oral or written views on the proposed amendment of Chapter 36 will be granted an opportunity at a hearing to be held before the Director of Insurance, State of Nebraska, beginning at 10:00 a.m., on the 18th day of May, 2009, and will continue until concluded. Said hearing will be held in the 5th Floor Conference Room of the Terminal Building at 941 “O” Street, Lincoln, NE 68508. Interested persons may submit written comments to the Department before the hearing date, which will be entered into the record.
