NOTICE OF ADOPTION - Chapter 86, Regulation to Implement the American Recovery and Reinvestment Act for Purposes of Continuation of Coverage for Small Group Insurance

Chapter 86 of the Insurance Department Rules has now been filed with the Secretary of State for adoption of an amendment which eliminated Section 9 of the regulation.

Chapter 86 entitled, “REGULATION TO IMPLEMENT THE AMERICAN RECOVERY AND REINVESTMENT ACT FOR PURPOSES OF CONTINUATION OF COVERAGE FOR SMALL GROUP INSURANCE,” was created to allow insureds in employer groups in the small group market to obtain a subsidy for continuation of coverage if they are involuntarily terminated. The rule was filed with the Secretary of State on December 31, 2009, with an implementation date of January 5, 2010. In that regulation, there was a sunset provision dated December 31, 2009. The federal government has extended and amended some portions of the American Recovery and Reinvestment Act of 2009. To alleviate any confusion, the sunset provision in Chapter 86 has been eliminated.
